No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal modifies the Missouri Motor Fuel Marketing Act to make unlawful the effect of injuring competition, in additional to the current language which targets intent. In any legal action brought pursuant to this act, the burden of proof shall shift to the defendant to show justification and in the absence of justification, courts shall award judgment for the plaintiff.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
