ASSUMPTION
Officials from the Office of Secretary of State (SOS) assume there would be costs due to
additional publishing duties related to the Missouri State Water Patrol's authority to promulgate
rules, regulations, and forms. SOS estimates the division could require approximately 6 new pages of regulations in the Code of State Regulations at a cost of $27.00 per page, and 9 new pages in the Missouri Register at a cost of $23.00 per page. Costs due to this proposal are estimated to be $369, however, the actual fiscal impact would be dependent upon the actual rule-making authority and may be more or less. Financial impact in subsequent fiscal years would depend entirely on the number, length, and frequency of the rules filed, amended, rescinded, or withdrawn. SOS does not anticipate the need for additional staff as a result of this proposal, however, the enactment of more than one similar proposal may, in the aggregate, necessitate additional staff.
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years.
ASSUMPTION (continued)
Officials from the Department of Public Safety - Missouri Water Patrol (MWP) state the temporary boating safety permit card that would be received for completing and passing the Boating Safety written examination would enable that person to operate a vessel on Missouri waterways for 30 days.
The MWP was unable to estimate the number of students that would complete and pass the course and request a temporary permit. The MWP states the $10 cost for the temporary boating safety permit card should cover the price of the materials to create the temporary boating safety permit. The fees collected for the temporary boating safety permits will increase State Revenue. The total revenue for the $10 fee collected for each temporary permit is unknown at this time.
The MWP states the FTE requested in the FY 2005 budget as a result of the passage of SB 1 from the 2003 session should be able to fulfill the needs to accomplish the requirements of this legislation.
Oversight has no estimate to the number of nonresident boaters, born after January 1, 1984 will apply for this temporary license. Oversight assumes an unknown amount of fee revenue and costs resulting from this proposal. Oversight will assume that the up-to $10 fee will be sufficient to cover the costs incurred by the MWP to implement this proposal. Oversight assumes the income and expenses incurred as a result of this proposal are in addition to what was represented in the fiscal note for Truly Agreed to and Finally Passed SB 1 from the 2003 session.
This proposal will increase Total State Revenues.

FISCAL IMPACT - Small Business
Certain small business entities (Marinas) would be able to rent boats to nonresident visitors born after January 1, 1984. These entities would be responsible for giving the examination as well as collecting and forwarding the $10 fee to the Missouri Water Patrol.
DESCRIPTION
This proposal allows nonresidents born after January 1, 1984, to operate a vessel on the lakes of this state with a temporary boater education permit. The permit may be obtained from the State Water Patrol by completing and passing a written examination developed by the Missouri State Water Patrol. The permit shall expire if the nonresident obtains a permanent identification card or 30 days after its issuance, whichever occurs first. A $10 fee will charged for the temporary permit. Upon successful completion of the test and prior to renting a vessel, the business entity responsible for giving the examination shall collect and forward the fees to the Missouri State Water Patrol. The temporary boater permit provision has a termination date of December 31, 2010.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
