FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Natural Resources stated this proposal would have no fiscal impact on their agency.



Officials from the Department of Elementary and Secondary Education (DESE) assume the proposal would require all moneys deposited into the Pettis County school fund prior to November 1, 2003 and up until December 31, 2005 in resolution of environmental law violations, to be deposited into the capital projects fund. There does not appear to be a cost or savings to the local school districts, rather a shifting of funds to allow spending on capital projects. DESE defers to the local school districts in Pettis County regarding the amount of such deposits.

Officials from the Sedalia Public Schools stated this proposal would clarify the intent of a $1,000,000 environmental law violation settlement that these funds would be exempt from the deductions from district entitlement as stated in Section 163.031.2 since the settlement was paid by a concentrated animal feeding operation. The monies were to be distributed on a per pupil basis to benefit all students living in Pettis County, with the Sedalia Public Schools to receive approximately $640,000.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal expresses that all monies received in the Pettis County school fund in resolution of environmental law violations shall be deposited into the capital projects fund.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
