FISCAL ANALYSIS



ASSUMPTION

Officials from the Department of Health and Senior Services (DOH) state this proposal would require two Consultant Community Health Nurses who would develop and distribute the educational information pertaining to this proposal. Staff would develop and provide training, research the appropriate uses of emergency contraception, and staff and coordinate advisory council activities. The nurses would travel throughout the state to educate medical professionals, pharmacists, and the community about the availability of emergency contraception.



DOH estimates it would print and mail at least four copies of the informational three color trifold brochure to 3,272 OB/GYN M.D.'s, 1,699 D.O.'s, 7,123 licensed pharmacists, 1,570 licensed pharmacies; 152 licensed hospitals, and 2,472 Nurse Practitioners for a total of 16,288 medical professionals. DOH estimates printing and mailing costs to be $11,965 in FY05, $14,789 in FY06, and $15,232 in FY 07.



Oversight has, for fiscal note purposes only, changed the starting salary for Consultant Community Health Nurses to correspond to the second step above minimum for comparable positions in the state's merit system pay grid. This decision reflects a study of actual starting salaries for new state employees for a six month period and the policy of the Oversight Subcommittee of the Joint Committee on Legislative Research.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal creates the "Woman's Right to Know Act". "Emergency contraception" is defined as any drug or device approved by the FDA that prevents pregnancy after intercourse.



The Division of Maternal, Child, and Family Health shall be responsible for raising public awareness and promoting counseling and referrals for all contraceptive devices approved by the Food and Drug Administration. The Division shall distribute information regarding the availability, safety, and effectiveness of emergency contraception and must stress that it is a method of pregnancy prevention that cannot harm or abort an established pregnancy. The information must also inform women that health plans which cover prescription drugs are also required to cover contraceptive drugs and devices.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
