FISCAL ANALYSIS



ASSUMPTION



Officials of the Office of Secretary of State (SOS) assume any fiscal impact from this proposal would be handled with existing budgeted resources and staff.



Officials of the Office of Secretary of State- Administrative Rules stated this proposal creates the Secretary's Council on Library Development, and the State Publications Access Program, and gives the authority to the Secretary of State to promulgate rules to implement the provisions of this bill. Rules are printed in both the Missouri Register, and the Code of State Regulations. Officials stated that based on experience, the rules and regulations and forms issued by the SOS could require as many as 10 pages in the Code of State Regulations. The estimated cost of a page in the Missouri Register is $23.00, and the estimated cost of a page in the Code of State Regulations is $27.00. The actual cost could be more or less than the numbers given. The impact in future years is unknown and depends upon the frequency and length of rules filed, amended, rescinded, or withdrawn. Officials estimated costs in FY 04 at ($615) and Unknown in FY 05 and 06.









ASSUMPTION (continued)



Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years. Oversight assume no fiscal impact to the Administrative Rules Division.



Officials of the Department of Public Safety- Missouri Veterans Commission assume they would need to send 50 annual reports to libraries and agencies. Officials estimate cost to the HOME FUND at 50 reports x $8.00 = $400 in FY 04.



Oversight assumes the Veterans Commission could request additional resources during the budget process if they would need additional resources. Oversight assumes no fiscal impact to the Veterans Commission.



Officials of the Department of Revenue - State Tax Commission assume their Commission could possibly realize a small savings in the cost of publication of the annual report as the current requirement to provide forty-five copies of the report has been removed. However, the new language provides that the state library would specify the number of copies needed. Should the library request more than the current forty-five, the Commission could possibly need additional revenue to cover this cost. Oversight assume no fiscal impact to the State Tax Commission. Oversight assumes any increase in publication cost would be minimal and could be dealt with in future appropriations.



Officials of the Department of Conservation assume any fiscal impact would be minimal. Oversight assumes any fiscal impact could be absorbed with existing resources.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This act creates and establishes rules for the "Secretary of State's Council on Library Development". The act establishes definitions for Sections 181.100 to 181.130 relating to the state libraries. The act removes Section 181.110 RSMo, which addresses state publications to be indexed and published. Finally the act establishes rules addressing publication of state materials.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
