FISCAL ANALYSIS



ASSUMPTION



Officials of the Office of Secretary of State (SOS) stated this proposal will open options for the format in which the SOS publishes administrative rules. Officials assume this will allow their office to look at publishing media that are both more cost efficient and technologically advanced.



Officials stated that one of their biggest expenses is publishing paper versions of the Missouri Register, and the Code of State Regulations. Officials assume that being allowed to publish the Missouri Register in purely electronic means and not publishing the paper issue would save the SOS annually $40,000. Officials assume there could be additional savings from this proposal, depending upon what media for publication of both the Missouri Register, and the Code of State Regulations is prescribed. Officials assume there could be additional minor savings from not storing incorporated by reference material. The actual savings could be more or less than the amount estimated. Oversight will show annual savings of $40,000 to Unknown.

DESCRIPTION

This act provides that the publishing of proposed rules in the Missouri Register and final administrative rules in the Code of State Regulations may be done in a format prescribed by the Secretary of State, or in writing upon request. A notice of proposed rule-making must include the text of the proposed rule with new matter printed in boldface type. Currently, new matter in a text may also be underlined.

The text of a rule, regulation, standard or guideline of a federal agency or a nationally or state recognized organization, which is incorporated by reference into an administrative rule must be available at the headquarters of the agency adopting the rule. Currently, both the agency and the secretary of state must make a copy of the referenced material available at their respective offices.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
