ASSUMPTION
Officials with the Office of State Courts Administrator, Department of Public Safety, and Department of Revenue (DOR) assume this proposal would have no fiscal impact on their agency.
Officials with the Office of Administration (OA) - Administrative Hearing Commission (AHC) assume this proposal could have fiscal impact on their agency. In FY03, DOR sent out letters giving 449 licensees an opportunity for hearing, though holding only 30 hearings. If DOR sought discipline in 449 cases, AHC would need to add one FTE attorney to process the cases. AHC assumes that this estimate is at the high-end of the range of possible hearings. Oversight assumes that AHC could handle the anticipated number of appeals with existing personnel and resources. However, if the number the complaints files with AHC reaches a high level, AHC would have to request additional personnel through the appropriation process.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal gives car dealers or manufacturers the right to file a complaint with the Administrative Hearing Commission (AHC) if the Department of Revenue (DOR) refuses to issue or renew their license.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
