ASSUMPTION



Officials from the Office of Secretary of State and the Office of the State Public Defender assume the proposed legislation would have no fiscal impact on their agencies.



Officials from the Office of State Courts Administrator assume the proposed legislation would have no fiscal impact on the courts.



Officials from the Department of Corrections (DOC) assume the proposal establishes that review hearings to place offenders in administrative segregation are not contested cases. Passage of this proposal will not change current DOC policy and procedure and there will be no fiscal impact.

DESCRIPTION



The proposed legislation would provide that a review hearing to place an offender in administrative segregation while in a correctional facility is not a contested case pursuant to Chapter 536, RSMo. The proposal contains an emergency clause.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
