FISCAL ANALYSIS

ASSUMPTION



Officials from the Office of Secretary of State - Elections Division stated this proposal would have no fiscal impact on their agency.



Officials from the Department of Elementary and Secondary Education indicated this proposal would have no fiscal impact on their agency. Election costs to local governments would depend upon the number of petitions file and the resulting number of elections held.



Officials from the Jefferson County Commission and the Platte County Board of Elections indicated there would be no known fiscal impact resulting from this proposal.



Officials from the Saint Louis Public Schools indicated there would be fiscal impact to their district.



Officials from LaClede County stated there would be costs involved in verifying petitions and would depend on the number of signatures to verify. The cost to schools for the election would vary depending on the date of the election and other entities who call an election at the same time.



Officials from the St Louis County Directors of Elections stated the cost would be indeterminate, but acceptable. Costs would be in the form of man-hours, which would vary from petition to petition, necessary to verify petition signatures.



ASSUMPTION (continued)



Officials from the Kansas City Election Board stated that they are unclear as to which entity has the authority to verify petitions. Costs for an election are as much as $1,500 per polling place.



Oversight assumes the costs of verifying petitions can be absorbed with existing resources.



Officials from the Kansas City Missouri School District stated the cost of a scheduled school board election to their district is about $95,000.



Oversight assumes that a recall election would be held at the same time as regular school elections; therefore, there should be no additional costs for a recall election.



Official from Cole County and the St Louis City Board of Elections did not respond to a request for fiscal note.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal formulates a new procedure of recalling school board members in addition to the methods for recall outlined in the academically deficient school statute. Upon a petition signed by at least 25% of the number voting in the last school board election, a recall election will be held. The proposal specifies the requirements for the filing, format, and verification of the petition.



DESCRIPTION (continued)



If a majority votes to retain the recalled member, the member remains in office and cannot be subject to another recall, except as provided in the academically deficient school statute. If the member is recalled, a successor will be chosen in the same manner as vacancies are filled for any 7-member district.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
