FISCAL ANALYSIS

ASSUMPTION



Officials from the Department of Mental Health, Department of Transportation, Department of Health and Senior Services, Department of Natural Resources, Department of Conservation, Office of the Governor, Office of the Secretary of State and the Department of Public Safety - Divisions of Capitol Police, State Highway Patrol, State Emergency Management Agency, Division of Alcohol and Tobacco Control, State Water Patrol and Division of Fire Safety each assume the proposal would not have a fiscal impact on their respective agencies.



Officials from the Office of the Attorney General (AGO) assume that they will field additional questions should this provision be adopted. However, the AGO assumes that the number of inquiries will not be substantial and that any additional costs can be absorbed with existing resources.



Officials from the St. Louis Metropolitan Police Department assume the proposal would not have a fiscal impact on their agency.



Officials from the Columbia Police Department, Kansas City Police Department, Greene County Sheriff's Office, Eureka Fire Protection District, Taney County Ambulance and the St. Charles County Ambulance District did not respond to our request for fiscal impact.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION



This proposal provides that a public governmental body is authorized to close a meeting or record to the extent they relate to operational plans, guidelines, policies or procedures held by an agency responsible for public health or safety that are used in responding to or preventing certain critical incidents or events that appear to be terrorist, criminal or hostile in nature and which have the potential to endanger an individual's or the public's safety. This exception does not apply to information regarding expenditures, purchases or contracts made by the agency to implement such plans, guidelines, policies or procedures.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
