ASSUMPTION
Officials from the State Treasurer's Office assume no fiscal impact to their agency.
Officials from the Department of Natural Resources assume this proposal would expand the authorized use of the Natural Resources Protection Fund. It would mandate that a portion of the air permit fees would be used to fund programs that encourage alternative energy sources. Because the specific programs to be funded by the proposed legislation have not been identified nor have funding levels been established the department is unable to determine the resulting fiscal impact.
The proposal would expand the authorized use of the Natural Resources Protection Fund. It would mandate that a portion of the air permit fees would be used to fund programs that encourage alternative energy sources.
The Air Pollution Control Program (ARCP) has established an emissions fee rate sufficient to comply with the provisions of RSMo 643.075. This included administering the Title V program, enforcement activities and technical support services necessary for permitting and monitoring activities required to comply with the Clean Air Act of 1990 (with amendments)(CAA). Fund 0594 contains emissions fees and permitting fees used to administer the Title V program, NSR

and permitting activities. The structure of the fee does not include provisions to fund programs to encourage development of alternative energy sources. Emissions Fees used to promote alternative energy sources, as specified in the proposal, would have a material impact on APCP's ability to monitor and maintain air quality as required in the CAA.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This act broadens the purpose of the fund to include the promotion of innovative programs that preserve the state's air, water and land resources. This act goes on to extend the use of air pollution permit fees to include funding programs that encourage alternative energy sources.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
