FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Economic Development, Department of Transportation, Office of State Court Administrator and Office of Attorney General assume no fiscal impact to their agency.



Officials from the Department of Natural Resources assume there will be an unknown fiscal impact on their agency. Section 253.393.2 "Members of the board receive no compensation for their service, but will be reimbursed for their actual and necessary expenses incurred in the performance of their duties." The amount of expenses for travel, lodging and meals for 12 board members would depend on the number of meetings held.



Section 253.393.3.(1) does not provide clear definition of amending "practice." Therefore, the impact from this provision is unknown.



Section 253.393.3.(2) "Maintain an inventory of historical monuments, ...on state sites,... municipal and private property." It would take significant number of labor hours unless there is a provision that the municipality or private owner has the responsibility to inform the department of the markers, grave markers, etc. on their property. Since this implies all veterans grave markers, the impacts will be perpetual and financially significant. The department is unable to estimate for the fiscal impact from this provision.



ASSUMPTION (continued)



Section 253.393.3.(3) "File and publish and annual report..." The report would need to include activity and status on all monuments, etc. on both private and public land. Unless there is a requirement that all public entities and all private land owners submit reports, it will take a very large number of labor hours to gather this information; however, the direct fiscal impact is unknown.



Oversight assumes the unknown cost are expected to exceed $100,000 per year.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This act creates the State Historical Monuments, Memorials and Markers Board. This is a 12 member board appointed by the governor with the advice and consent of the Senate. Members of the Board receive no compensation but are reimbursed for necessary expenses.



DESCRIPTION (continued)



The Board shall hold public meetings regarding the addition, modification or removal of any permanent monument on any site under the control of the department, maintain an inventory of

historical monuments and memorials on state, municipal and private property and file and publish an annual report of the activity and status of all historically designated monuments, memorials, and veterans grave markers.



This act also makes it a Class A misdemeanor for any person to knowingly remove, deface or destroy any monument, memorial or veterans grave marker.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
