ASSUMPTION
Officials from the Department of Health and Senior Services and the St. Louis County Circuit Clerk's Office assume the proposed legislation would have no fiscal impact on their agencies.
Officials from the Office of Administration - Division of General Services assume there is no cost impact to the state as the state does not employ physicians to provide services to county jails.
Officials from the Office of State Courts Administrator assume the proposed legislation would have no fiscal impact on the courts.
Officials from the Office of Attorney General (AGO) assume costs can be absorbed because the AGO assumes the state is not employing doctors who provide medical services to inmates of county jails. If in the future the state hires doctors who provide this service, AGO anticipates unknown costs to handle litigation arising from claims under Section 105.711.2(3).
ASSUMPTION (continued)
Officials from the Office of Secretary of State (SOS) assume the proposal includes health care providers working in county jails in the legal expense fund. The Department of Health and Senior Services could promulgate rules to implement the provisions of this act. These rules will be published in the Missouri Register and the Code of State Regulations. Based on experience with other divisions, the rules, regulations, and forms issued by the Committee could require as many as 4 pages in the Code of State Regulations and half again as many pages in the Missouri Register, as cost statements, fiscal notes, and the like are not repeated in the Code. The estimated cost of a page in the Missouri Register is $23 and the estimated cost of a page in the Code of State Regulations is $27. Based on these costs, the estimated cost of the proposal is $146 in FY 04 and unknown in subsequent years. The actual cost could be more or less than the numbers given. The impact of this legislation in future years is unknown and depends upon the frequency and length of rules filed, amended, rescinded, or withdrawn.
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which would require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process.
Officials from the Greene County Sheriff's Office and the Jackson County Sheriff's Office did not respond to Oversight's request for fiscal impact.

DESCRIPTION
The proposed legislation would include health care providers that provide services to patients or inmates of county jails within the State Legal Expense Fund.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
