ASSUMPTION
Officials from the Department of Economic Development - Division of Professional Registration, Department of Elementary and Secondary Education, Department of Mental Health and the Department of Social Services assume the proposal would have no fiscal impact on their agencies.
Officials from the Secretary of State's Office (SOS) assume the rules, regulations and forms promulgated could require as many as 24 pages in the Code of State Regulations. For any given rule, roughly half again as many pages are published in the Missouri Register as in the Code because cost statements, fiscal notes and the like are not repeated in the Code. SOS estimates the cost of a page in the Missouri Register and the Code of State Regulations to be $23 and $27, respectively. SOS emphasizes the actual costs could be more or less than the estimated cost of $1,476 for FY 2004. SOS states the impact of this proposal in future years is unknown and depends upon the frequency and length of rules, filed, amended, rescinded or withdrawn.
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple proposals pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal requires licensed professional counselors who wish to diagnose persons with mental and emotional disorders to complete certain graduate education in the diagnosis of persons with mental and emotional disorders. This requirement shall apply to initial licensees beginning August 28, 2005, and current licensees beginning August 28, 2006.
The proposal creates new definitions for "assessment," "consulting," "the practice of professional counseling," "professional counseling," "referral" and "research."
The State Committee of Psychologists and the Committee for Professional Counselors shall establish by joint rules the criteria for the 1,000 hours required in the diagnosis of persons with mental and emotional disorders for those persons holding a current professional counselors license on the effective date of proposed section 337.510.1(4).
The Committee for Professional Counselors may establish continuing education requirements necessary for licensees to maintain or renew their licenses.
