ASSUMPTION



Officials from the Office of Secretary of State and the Department of Public Safety - Division of Fire Safety assume the proposed legislation would have no fiscal impact on their agencies.



Officials from the Logan-Rogersville Fire Protection District did not respond to our request for fiscal impact. However, in response to an identical proposal from a previous session, officials stated that the proposal would not appear to have any further financial impact than statutes, regarding recall of board directors, currently provide.



Officials from the Chesterfield Fire Protection District, St. Charles Fire Protection District, Mehlville Fire Protection District, Raytown Fire Protection District, and the Eureka Fire Protection District did not respond to Oversight's request for fiscal impact.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



The proposal requires that a fire district board member commit some act of misconduct, malfeasance or nonfeasance relating to official board duties, or that the board member be convicted of any felony or any Class A or B misdemeanor, before a registered voter from that district could initiate recall proceedings.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
