FISCAL ANALYSIS



ASSUMPTION



Officials with the Office of State Courts Administrator, Department of Public Safety (DPS)-Division of Fire Safety, DPS-Division of Water Patrol, DPS-Division of Liquor Control, DPS-Highway Patrol, Department of Natural Resources and Department of Mental Health assume there would be no fiscal impact to their agencies.



From an identical proposal, Kansas City and St. Louis Metro Police stated there would be no fiscal impact.



Officials with the Department of Revenue (DOR) assume this proposal could allow a law enforcement officer to submit alcohol arrest reports without having the submitting officer's signature notarized. This could have a cost savings for processing and mailing rejections.



DOR also assumes this proposal could allow the department to honor a request for an administrative hearing without the surrender of a drivers license on a DWI hearing. This could create savings in processing and mailings.



It is further assumed that this proposal could eliminate the requirement for DOR to mail administrative DWI hearing results by certified mail. This could create saving for processing and mailing.



ASSUMPTION (continued)



With information from DOR, Oversight assumes this proposal could have a minimal administrative cost savings at various law enforcement agency levels. This savings would come from less of a need for notaries (and associated cost) in the agencies as well as personnel time to handle rejects and search for the drivers license before an administrative hearing.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.















DESCRIPTION



This proposal could allow alcohol related reports to be certified by an officer rather than verified (notarized). This proposal could also allow the forfeit of a license before an administrative hearing to be voluntary rather than mandatory and allow DOR to send notices first class rather than certified mail.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
