FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Higher Education and the Department of Public Safety - Missouri State Highway Patrol stated that this proposal would have no fiscal impact on their agencies.



Officials from the Department of Elementary and Secondary Education (DESE) indicated DESE would incur printing costs to issue the certificates; however, they do not expect the costs to exceed $100,000.



Oversight assumes that since the proposal allows for a fee to be assessed for the issuance of the career continuous professional certificate, the costs associated with issuing the certificates will be recovered.



This proposal would increase total state revenue.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



Section 161.092



This proposal adds a condition to the State Board of Education's authority to classify the public schools of this state that states that any rule requirements for the purpose of classifying the public schools must be in place for two years prior to implementation. However, the "two years prior to implementation" condition shall not apply to any requirement for which a time line for adoption is mandated in either federal or state law.

Section 168.021



This proposal provides for two levels of professional certification for teachers: an initial four year professional certificate and a career continuous professional certificate. A fee, not to exceed the combined costs of issuance and any criminal background check required as a condition is issuance, shall be charged for the career continuous professional certificate.



Requirements for the initial four year professional certificate include: participation in a mentoring program for a minimum of two years; completion of thirty hours of professional development (which may include hours spent in class in an appropriate college curriculum);

participation in a beginning teacher assistance program. The career continuous profession certificate requires the completion of four years of teaching under the initial professional certificate and fifteen contact hours of professional development per year.



Pre-1988 certificate holders are exempt from professional development requirements.



The proposal adds reactivation procedures for teachers who have not been in an educational position for three years or more.

Additionally, the act mandates that the State Board issue a professional certificate classification, most closely aligned to applicant's current areas of certification to any person, upon an appropriate background check, who is hired to teach in a public school in this state and who possesses a valid teaching certificate from another state. The certificate-holder must annually complete requirements for that level of certification.



Section 168.071



This section adds the crime of enticement of a child or attempting to entice a child to the list of offenses for which the certificate of license to teach shall be revoked or, in the case of an applicant, a certificate shall not be issued, if the certificate holder or applicant has pleaded guilty to or been found guilty of pursuant to Missouri or offenses of a similar nature established under the laws of any other state or of the United States, or any other county, whether or not the sentence is imposed.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
