FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Conservation assume this proposal would have an unknown negative impact on the Conservation Commission Fund depending on the amount of staff time which might be required.

Officials from the Department of Revenue, the Missouri Lottery, and the Missouri Highway Patrol assume this proposal would have no impact on their organizations.

Officials from the Office of the Attorney General did not respond to this proposal.

Officials from the Gaming Commission did not respond to this proposal; however, in response to a similar proposal they assumed the proposal would have no impact on their organization.

Oversight assumes there would be an insignificant number of such contests conducted and that the cost, if any, could be absorbed by the Department of Conservation.

DESCRIPTION

The proposal would allow fishing contests to be conducted without a permit or other authorization from the Department of Conservation. The fishing contest could be conducted on any lake having a shoreline of at least one hundred ten miles if:

(1) The contest is part of a multi-state fishing contest or sweepstakes;

(2) Only one tagged fish per lake participating in the contest has a value not in excess of one million dollars;

(3) The tagged fish shall be tagged by the sponsor of the contest or sweepstakes in the presence of a representative from the department of conservation;

(4) A fishing license is required in order to participate;

(5) There is no fee or other consideration required to enter or participate in the contest or sweepstakes; and

(6) The contest has a duration of less than thirty days.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
