In response to almost identical legislation of this session officials of the City of Harrisonville, a city located in Cass County, assume no fiscal impact; however, officials assume the proposal could hinder the economic and physical development of their city.

Oversight assume this proposal amends annexation laws and would have no state fiscal impact.

Entities not responding to this proposal are as follows: City of Belton, and the Kansas City Manager's Office.

FISCAL IMPACT - State Government FY 2004 FY 2005 FY 2006
$0 $0 $0

FISCAL IMPACT - Local Government FY 2004 FY 2005 FY 2006
$0 $0 $0

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.

DESCRIPTION

This substitute provides that any unincorporated area having a private 18 hole golf course community and at least a 100 acre lake within Cass county may incorporate as a city regardless of any proposed annexation of the area by certain cities. Any attempt of a city to annex the unincorporated area shall not be effective until after the voters of the unincorporated area fail to approve the proposed incorporation of the area as a city.

This act exempts any proposed city, town or village located within Cass county from the prohibition against a proposed municipality being organized within two miles of the limits of certain existing cities.

This act contains an emergency clause.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
