ASSUMPTION



Officials from the Department of Economic Development, Office of Public Counsel assume this proposal would not fiscally impact their agency.



Officials from the Department of Economic Development, Public Service Commission (PSC) assume this proposal would remove any PSC oversight of high speed Internet access service or broadband service, regardless of technology or medium used to provide such service. The proposal will remove the PSC's ability to exercise its authority under federal rules to add unbundled network element requirements to the national unbundled network requirements. PSC assumes this proposal would not fiscally impact its agency.

FISCAL IMPACT - Small Business



Small businesses that provide internet services may be affected by this proposal since it may modify the way competitive providers are able to provision services to customers if the PSC's authority is removed "regardless of technology or medium used to provide service" and if incumbent obligations for unbundling are limited to the requirements under the Federal Communications Commission's regulations.





DESCRIPTION



This proposal prohibits the Public Service Commission from regulating high-speed Internet access or broadband service. The proposal also requires incumbent local exchange telecommunications companies to provide unbundled access to network elements only to the extent required by federal regulations.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
