FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Public Safety - Division of Fire Safety and the Department of Mental Health assume this proposal would not fiscally impact their agencies.



Officials from the Department of Health and Senior Services (DOH) assume the Division of Family Services would continue to utilize only those entities that they license, therefore DOH would not have any additional sanitation inspections to be administered. Based on this assumption, DOH estimates no fiscal impact.



Officials from the Department of Social Services - Division of Family Services (DFS) state this proposal would require currently religiously exempt foster homes, residential care facilities, or child care placement organizations to become accredited by a nationally recognized organization or an organization incorporated in Missouri that is registered with the Department of Health and Senior Services. The proposal would require religious foster homes, residential care facilities, or child placement organizations to show proof of compliance with all Department of Health and Senior Services sanitation standards and fire code standards recognized by the Division of Fire Safety.



The DFS states based on the current estimate of about 146 agencies that would need to register, ASSUMPTION (continued)



plus other agencies in the future, two new Regional Licensing Consultants and one clerical support would be required to track the registration process and do site visits. The DFS anticipates that verification of compliance with sanitation and fire ans d safety standards would be required.

FISCAL IMPACT - Small Business



Small businesses could be fiscally affected if they are required to meet additional fire or sanitation standards.



DESCRIPTION



This proposal requires certain facilities for children to show proof of accreditation and compliance with safety standards. Currently, Section 210.516, RSMo, requires licensure of all residential care facilities, foster homes, and child placing agencies, but exempts other facilities, such as those run by religious organizations.



This proposal requires religious license-exempt facilities to be accredited either by a nationally recognized organization or by an organization incorporated in Missouri with bylaws and rules adhered to by other facilities. Religious license-exempt facilities must be registered with the Department of Health and Senior Services and comply with sanitation and fire standards established by the state.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
