ASSUMPTION
Officials from the Department of Labor and Industrial Relations (DOL) state the Division of Labor Standards is the agency charged with enforcement of Missouri's Prevailing Wage Law. The Division receives complaints about alleged violations of the law from workers, worker representatives, public bodies, contractors that bid the project but were not awarded the contract, other contractors that may be performing work on the same project but under a different contract for different services, and contractors that did not bid the project but are familiar with the type of work contracted for by the public body.
DOL assumes if non-contracted contractors or worker representatives could not file complaints, it is impossible to determine whether complaints would be filed by an alternative party allowed by the new language. DOL assumes the impact would be unknown cost under $100,000.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal limits the people who may complain of alleged prevailing wage violations to either agents/officers of the contracting public body or employees of the contractor/subcontractor subject to the public works contract. The Department of Labor and Industrial Relations shall investigate the complaint and either confirm the violation or dismiss the complaint. Payments may not be withheld until the alleged violation has been confirmed by the department.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
