ASSUMPTION
Officials from the Missouri House of Representatives, the Missouri Senate, and the Office of the Governor assume this proposal would fiscally impact their agencies.
Officials from the Department of Health and Senior Services (DOH) stated the proposed legislation would not be expected to significantly impact the operations of the DOH. If the proposal were to substantially impact the DOH programs, then the DOH would request funding through the legislative process. The DOH would make information available to associations through the department's web-site and by communication through association newsletters if changes to the legislation are made. The associations can then make the information available to the related organizations.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal creates a food recovery program for restaurants and charitable or nonprofit organizations to provide food to needy persons.
A new Section 192.081 is created with definitions for "donor", "food", "perishable food", and "prepared food". The intent is to make surplus food available to charitable and nonprofit organizations or volunteers for distribution to the homeless or those in need of food. Any donor and charitable or nonprofit organization acting in good faith will not be subject to criminal penalty or civil damages arising from the condition of the food.
Reasonable efforts should be made between donors and charitable or nonprofit organizations to contact each other for the collection of food. The Department of Health and Senior Services shall make available information detailing the need of food-recovery programs and the manner in which organizations may become involved. must develop and annually update a public information brochure regarding food recovery.
This proposal eliminates sections 196.365 thru 196.445 which relate to the manufacture of soft drinks and beverages.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
