SCS/SB 1171 - This act requires public bodies to ensure that bidders, offerors, contractors, or subcontractors, when engaged in procuring or letting contracts for any purpose, are not discriminating based on an environmental, social and governance score, as defined in the act. The act prohibits a public body from entering into a contract with a company, as defined in the act, for goods or services unless the contract contains a written verification from the company that it does not use environmental, social, and governance scoring. This provision does not apply if the public body determines these requirements are inconsistent with the public body's constitutional or statutory duties related to the issuance, incurrence, or management of debt obligations or the deposit, custody, management, borrowing, or investment of funds. This act only applies to contracts that: · Are between a public body and a company with 10 or more full-time employees; and · Have a value of $50,000 or more that is to be paid wholly or partially from public funds of the public body.
