SB 979 - This act exempts ski area operators from liability from operating such facilities. Under the act, it is presumed that a skier expressly assumes the risks and legal responsibility for injury, death or loss to person or property that results from the inherent risks of skiing. Under the act, the ski area operator shall not owe a skier the common law duty that a premise owner owes to a business invitee. The ski area operator shall have no legal liability provided that it follows the responsibilities delineated for it under the act. The act sets forth the responsibilities of a skier. Ski area operators and skiers who fail to fulfill their responsibilities listed under the act shall be liable for injuries and deaths. STEPHEN WITTE
