SCS/SB 1232 - This act, entitled "The Competitive Government Act", requires that all state agencies assess their current functions every other year beginning in 2005 to determine what functions could be performed by a private sector contractor. The act requires that a list be prepared by the agencies and sent to the office of administration and the state competition council, which has not yet been established. Until the council is established, the Office of Administration will perform the council's duties. Once the list is established and published, the agencies will prepare a competitive sourcing plan under the direction of the council. For future activities that are included on the list, the agencies and private sector groups will enter a competitive bidding process. The act instructs agencies to consider all costs, including quality assurance, liability insurance, and others in order to have accurate comparisons with private sector bidders. The act provides that an interested party may challenge an omission or an inclusion of an activity on the list. The act also provides for administrative review of such challenge. JEFF CRAVER
