SB 935 - Currently, when a mechanics' lien arises before a deed of trust, the lien is superior as to both the land and any subsequent buildings and improvements. This act removes the provision establishing superiority as to the land. Currently, when an individual does work on property subject to an existing deed of trust, the lien claimant's interest is superior to the holder of the existing deed as to the buildings, erections, and improvements and conversely, the holder of the deed retains an interest in the land superior to the lien claimant.
