SB 858 - In addition to current provisions, this act states that a person commits the crime of failure to return to confinement if he or she fails to return while: (1) Having been remanded to the custody of the county sheriff for transportation to the Missouri Department of Corrections; or (2) Being temporarily furloughed during his or her sentence. Currently, the crime of failing to return to confinement is a Class C misdemeanor, unless certain specific circumstances exist, in which case, the penalty is increased to a Class A misdemeanor or Class D felony. Under this act, failure to return to confinement is a Class A misdemeanor if the underlying offense for which the person is serving time is a misdemeanor and a Class D felony if the underlying offense for which the person is serving time is a felony.
