SB 908 - Under current law, a person does not commit the Class B misdemeanor of first degree trespassing by entering or remaining on property that is not fenced, enclosed, or posted, or if the person has not received actual notice that he or she is trespassing. Current law also provides that anyone who unlawfully enters the property of another regardless of the person’s mental intent, the physical characteristics of the property, or any other aspect of the trespass is guilty of the infraction of second degree trespassing. Under this act, anyone who knowingly and unlawfully enters or remains in or on the property of another is guilty of the Class B misdemeanor of trespassing regardless of whether he or she was given notice or whether the property was posted, enclosed, or fenced.
