CURRENT BILL SUMMARY
SB 1038 - Currently an individual who was found guilty of a felony and was then later determined to be innocent due to DNA testing may be paid restitution in the amount of $50 per day for each day of postconviction incarceration. However, no individual shall be paid more then $36,500 per year. This act changes the amount of restitution that such individual can receive to $100,000 for each year of incarceration if the individual was sentenced to death and $50,000 for each year of incarceration for all others.
