SJR 38 - This constitutional amendment, if approved by the voters, will impose a sales tax equal to two cents per cigarette and a twenty percent tax on the manufacturer's invoice price of other tobacco products. The revenue derived from this tax will be placed into the Healthy Future Trust Fund created by this act. The actual costs of collecting the tax imposed by this act will be paid from the moneys in the Healthy Future Trust Fund, not to exceed four percent of the total moneys collected. Two accounts, the Chronic Disease Management Account and the Tobacco Use Prevention, Education, and Cessation Account, are created within the Healthy Future Trust Fund. Upon appropriation, the moneys deposited in the healthy future trust fund will be allocated to the Chronic Disease Management Account and the Tobacco Use Prevention, Education, and Cessation Account, which are created within the Healthy Future Trust Fund. The funds allocated to both accounts are specifically prohibited from being used to fund abortion services. The Chronic Disease Management account will receive sixty-five percent of the net proceeds from the tax in the Healthy Future Trust Fund. The Tobacco Use Prevention, Education, and Cessation Account will receive thirty-five percent of the net proceeds from the tax in the Healthy Future Trust Fund. An oversight committee is created to assist other state agencies in monitoring the use of funds and assessing the efficiency of programs funded through the Tobacco Use Prevention, Education, and Cessation Account. In addition, the state auditor will perform an annual audit of the funds and programs established under this act. The moneys deposited in the Chronic Disease Management Account shall be appropriated to the Department of Social Services to provide funding for health care access cards for uninsured Missourians and the costs of administering such program.
