SB 774 - Whenever a Governor appoints an acting department director or acting member of a board or commission and does not submit such appointment to the Senate for its advice and consent, this act limits the time period of the authority for such department head or member of a board or commission. If the acting appointee is appointed during a regular or special session of the Senate, the authority of the appointee shall terminate thirty days after the appointment or final date of such session, whichever date comes first. If the Senate is not in session, then the authority of the appointee shall terminate thirty days after the Senate has convened in the next regular or special session. Such acting appointee cannot be reappointed to subsequently serve as acting director for the same department or as an acting member of the same board or commission. For appointed members of boards and commissions, this act provides that the authority of such members to act exists during the pendency of their terms and for up to sixty days after the expiration of their terms. If no replacement is named by the Governor during that sixty day period, then the office shall be vacant. This act is identical to the introduced version of SB 667 (2014). JIM ERTLE
