CURRENT BILL SUMMARY
SB 480 - During the initial appearance of a defendant charged with the offense of trespass by an illegal alien, this act requires the court to make a finding as to whether or not the person is seeking asylum. If the person is seeking asylum and is not a danger to the community, then the court may authorize the release of the person under such conditions as the court may impose. If such person is found to be danger to the community, then the person shall not be released from custody during the trial. In order to be charged with the offense of trespass by an illegal alien, the person must be at least eighteen years of age. If the person is driving a motor vehicle at the time of arrest, such motor vehicle shall be confiscated until such time as the person can show that he or she is lawfully present in this country. Finally, duress shall be an affirmative defense to the offense of trespass by an illegal alien.
