BILL SUMMARIES

INTRODUCED

HJR 31 -- Motor Fuel

Co-Sponsors:  Klindt, Seigfreid, Summers, Williams (121),
Parker, Kreider, McBride, Luetkemeyer, Marble

This proposed constitutional amendment reduces the tax on motor
fuel imposed by statute to 11 cents per gallon and mandates that
such rate be subject to change only by referendum or by
amendment of the constitution.

An additional 6 cents per gallon tax on all motor fuel will be
imposed and distributed as follows:

(1)  The County Aid Road Trust Fund will get 10%;

(2)  Cities, Towns and Villages will get 15%; and

(3)  The remaining 75% will be placed in a newly created Fifteen
Year Highway Project Fund within the state treasury.  Moneys in
this fund will be used solely for the completion of the projects
listed in the 15 year highway project of the Department of
Transportation as published in 1992.  The Department of
Transportation, for disbursement purposes, must list
expenditures made on the 15 year program during the preceding
month, and the State Treasurer will disburse funds to the
department to cover such expenditures or the full amount if the
expenditures exceed the amount in the fund at the end of the
month.  The State Auditor and the State Treasurer will have
access to all records of the Department of Transportation's
expenditures on projects.  The State Auditor may audit these
records when he or she deems necessary.

This 6 cent tax will terminate in 15 years and any moneys
remaining in this fund will be transferred to the motor fuel tax
fund.
