COMMITTEE ACTION: Voted "do pass" by the Committee on Criminal
Law by a vote of 13 to 5.
This bill creates the class D felony of offender sexual abuse.
An employee of the Department of Corrections commits the crime
if the employee has sexual intercourse, deviate sexual
intercourse, or sexual contact with an offender.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill is necessary to
strongly discourage consensual sex between inmates and
correctional facility employees, because of the inappropriate
nature of such conduct. Supporters say that consensual sex
cannot, in effect, actually take place between inmates and
correctional facility employees because of the imbalance of
power that exists between the parties.

OPPONENTS: There was no opposition voiced to the committee.
