HB 75 -- Commercial Driver's License

This bill requires that a person submit a medical examination by
a licensed physician in order to receive a commercial driver's
license.
The Director of Revenue may determine that an applicant is
ineligible for a license based on a medical examination that
indicates the applicant has a history of a mental or physical
aliment, disability, or disease that may impair his or her
ability to safely operate a commercial motor vehicle. However,
the applicant may establish eligibility notwithstanding the
ailment, disability, or disease by submitting further medical
information, as required by the director, which demonstrates
that the applicant has the ability to safety operate a
commercial motor vehicle.
A medical certificate will be issued to any applicant who is
required and satisfactorily demonstrates medical eligibility.
Any commercial driver issued a medical certificate must not
operate a commercial motor vehicle without having the
certificate in his or her immediate possession.
The director, by rule, may establish driving restrictions for
classes of licensees with such special medical ailments
necessary to insure the safe operation of such vehicle.
Any applicant at renewal time which has previously been issued a
medical certificate must, in addition to the standard renewal
requirements, submit a current report of a medical examination.
The director will renew a license and the medical certificate
based on the current report of a medical examination.
