HB 729 -- Driving With an Extreme Blood Alcohol Content

Sponsor: Froelker

This bill creates the crime of driving with an extreme blood
alcohol content (BAC). A person commits this crime by driving
with a BAC of .15% or more. Driving with an extreme BAC is a
class A misdemeanor. If the person is found to have a prior
alcohol-related driving offense, then the crime is a class D
felony. If the person is found to have 2 or more prior alcohol-
related driving offenses, then the crime is a class C felony.

In addition, the bill also requires the Director of Revenue to
suspend in certain situations and to revoke in other situations
the driver's license of a person who has been found guilty of
driving with a BAC of .15% or more.
