HB 703 -- RECORDERS OF DEEDS

SPONSOR:  Kennedy

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee
on Local Government and Related Matters by a vote of 17 to 0.

This bill allows the recorder of deeds in any municipality or
county to establish an electronic format for the recording or
filing of documents.  Documents may be recorded, filed,
transmitted, stored, and maintained in electronic format as
determined by the recorder.  Requirements for the electronically
transmitted signature of a person are outlined.

The bill also allows the recorder of deeds in any municipality
or county to establish a revenue collection procedure of prepaid
accounts for the payment of required recordings or filing fees,
including payment by credit or debit cards.  Funds in prepayment
accounts are refundable upon written order of the authorized
party designated to transfer moneys from the account.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that this bill will help recorders
use technology in their jobs.  Electronic recording is used in
other states.

Testifying for the bill were Representatives Kennedy and
Crawford; and Boone County Recorder of Deeds.

OPPONENTS:  There was no opposition voiced to the committee.
