INTRODUCED

HB 434 -- Family and Student Privacy

Sponsor:  Levin

Public elementary and secondary schools are prohibited from
administering tests or requiring students to respond to surveys
regarding student attitudes, values, beliefs, or behavior unless
each inquiry is authorized by the student, if more than 17 years
of age, or the parent or guardian of the student.  The bill
specifies the information required on the authorization form.
School districts violating this provision are liable for up to
$100,000 of actual and punitive damages per occurrence;
individuals who administer such inquiries in violation are
guilty of a class C misdemeanor and may be fined up to $1,000.
