INTRODUCED

HB 380 -- Grand Jury Proceedings

Sponsor:  Schilling

The bill requires a stenographic or electronic recording of all
witness testimony before a grand jury.

The bill also provides that:

(1)  An unintentional failure to record testimony does not
affect the validity of a prosecution;

(2)  The record of the testimony must remain in the custody of
the state's attorney unless otherwise ordered by the court;

(3)  Recorded testimony is a closed record pursuant to the
state's sunshine law (chapter 610); and

(4)  Transcripts must be accessible to the parties, at their
cost, as provided by Missouri Supreme Court rule.
