HB 335 -- Chemical Tests for Alcohol

Co-Sponsors: Hosmer, Schilling

This bill allows a law enforcement officer to administer a
chemical test when the officer suspects a person is driving
while intoxicated. The test is admissible in court as evidence
of probable cause to arrest and as exculpatory evidence but not
as evidence of blood alcohol content. Current law allows only
the Highway Patrol or certain medical personnel to administer a
chemical test.
