HCS HB 194 -- TANNING FACILITIES

SPONSOR:  Treadway (Reynolds)

COMMITTEE ACTION:  Voted "do pass" by the Committee on
Professional Registration and Licensing by a vote of 15 to 0.

This substitute requires that all tanning facilities be licensed
with the Department of Economic Development.  The Division of
Professional Registration will promulgate rules and regulations
pertaining to the operation of tanning facilities.

The substitute defines tanning facilities, tanning devices, and
photo therapy devices.

Warning statements must be given to every customer prior to use
of any device in a tanning facility.  Tanning facilities are
also required to post signs warning of ultraviolet radiation and
the long term effects to the human body caused by ultraviolet
radiation.

The substitute requires tanning facilities to have operators on
duty who are knowledgeable of the operation of tanning equipment
on the premises.  Facilities must provide customers with eye
protection; show customers all physical aids within the
facility; use accurate timers on all devices; limit exposure to
that recommended by the manufacturer; and maintain the
facility's interior temperature.

All customers must sign a written statement that they have read
and understand all warnings presented by the facility before
being allowed to use any device within the facility.  All
persons between the ages of 14 and 18 must provide the operator
of the facility with a written statement from a parent or
guardian saying that they understand all warnings given by the
facility before allowing the minor to use any devices in the
facility.

The substitute requires the division to promulgate rules
pertaining to hygienic practices and sanitary operations of
tanning facilities.

The substitute also creates the Tanning Facility Fund.  Money
placed in the fund will be used for the purpose of administering
the operations incurred by the division.

Violation of any provisions of this substitute is a class C
misdemeanor.

FISCAL NOTE:  Estimated Net Effect to Tanning Facility Fund of
an income of $120,000 in FY 2000, a cost of $86,842 in FY 2001,
and an income of $7,354 in FY 2002.  Estimated Net Effect to
Professional Registration Fees Fund of a cost of $100,380 in FY
2000, an income of $100,380 in FY 2001, and $0 in FY 2002.

PROPONENTS:  Supporters say that overexposure to ultra violet
radiation in tanning beds is quite common.  The consumer needs
to know the potential dangers involved with the use of tanning
beds.

Testifying for the bill was Representative Reynolds.

OPPONENTS:  There was no opposition voiced to the committee.
