HB 138 -- Termination of Parental Rights

Sponsor:  Campbell

Under current law, one basis for terminating parental rights is
that a parent is unfit to be a party to the parent and child
relationship.  Unfitness is presumed upon a showing that within
a 3 year period immediately prior to the termination
adjudication, the parent's parental rights to one or more other
children were involuntarily terminated.  This bill changes the
standard for activating the presumption of unfitness to a
showing that within a 3 year period immediately prior to the
filing of a petition for termination of parental rights, the
parent's parental rights to one or more other children were
involuntarily terminated.
