HB 131 -- Employee Rights

This bill entitles an employee (including a former employee) to
obtain a copy of his or her personnel file, if such a file is
maintained. The employer may charge a reasonable duplication
fee. Employers that maintain a personnel file must retain such
files for at least one year after an employee leaves
employment. The employer is not required to provide access to
the file more than once every 6 months. Any employer improperly
denying an employee access to his or her file will be subject to
a forfeiture of $25 per day, up to $500, for each day that
access to the file is denied. An employer may also be liable
for the employee's attorney's fees and court costs. The
provisions of the bill would not supersede any conflicting
provisions in a collective bargaining agreement.
