CCS/SCS/HS/HCS/HB 852 - This act revises civil commitment of sexual predators provisions to include persons not currently in the physical custody of an agency with jurisdiction, who have previously pled guilty to or been convicted of a sexually violent offense, and who have committed a recent overt act, defined as an act that creates a reasonable apprehension of sexually violent harm. Additionally, until December 31, 2001, a person who has pled guilty to or been convicted of a sexually violent offense and who has been in custody within the preceding 10 years but who no longer is in custody may be determined to be a sexual predator and civilly committed even without committing a recent overt act.

The Director of the Department of Mental Health is authorized to determine the appropriate secure facility to house a sexually violent predator. The act also requires the Public Defender's office to represent indigent individuals alleged to be predators both at trial and on appeal.
