FISCAL ANALYSIS

ASSUMPTION

Secretary of State (SOS) officials assume no fiscal impact to their office.

The Cooper County Clerk stated that Section 115.124 currently allows hospital trustees to assume the responsibilities of their office if they had been elected when the number of candidates who have filed is equal to the number of positions to be filled. Officials assume no fiscal impact.

The Cass County Clerk stated that if this proposal had been the law in April of 1998, Cass county would have saved $13,942.93 in election cost. Officials estimate that the potential would exist for Cass County to save election costs of $14,000 in FY2000, $14,700 in FY2001, and $15,400 in FY2002.

Oversight assumes that certain counties would avoid election costs if the number of candidates who have filed for a particular office, as setforth in this proposal, equals the number of positions to be filled. Projected savings on a statewide basis is unknown.

No direct fiscal impact to small businesses would be expected as a result of this proposal.






DESCRIPTION

Section 205.180 of this act provides that an election would not be held to select hospital trustees, if there are no more candidates for hospital trustees than there are positions to fill. Such candidates shall assume their offices at the same time and manner as if elected.

Section 65.110 of this proposal provides if the number of candidates for any townships office is no greater than the number of officers to be elected, no election would be necessary for that office.

The Township Offices that this proposal would affect are: Trustee, Ex Officio Treasurer, Collector, Clerk and Township Board.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
