FISCAL ANALYSIS

ASSUMPTION

Officials of the Department of Economic Development - Division of Motor Carrier and Railroad Safety assume the proposal would change the retirement benefits for the division's administrative law judges (ALJs). Currently these individuals are considered regular employees under the Missouri State Employees' Retirement System (MOSERS). This proposal would allow them to be classified as ALJs under MOSERS, for which the state's contribution rate is 20.10% as opposed to 11.91% for regular employees as of July 1, 1999. Officials assume the Highway Fund fringe benefit transfer will increase in proportion to this percentage increase for the two current ALJ positions.

Missouri State Employees' Retirement System (MOSERS) officials also note that ALJs under the Division of Motor Carrier and Railroad Safety are currently members of the general employee plan. The proposal would make these positions eligible to participate in the Administrative Law Judges' and Legal Advisors' Retirement System administered by MOSERS, at a state contribution rate of 20.10%.

DESCRIPTION

The proposal would provide that administrative law judges of the Department of Economic Development-Division of Motor Carrier and Railroad Safety receive the same benefits as administrative hearing commissioners.
