FISCAL ANALYSIS

ASSUMPTION

Officials from the Office of State Courts Administrator (CTS) assume the proposed legislation would add a circuit judge in the 11th Circuit (St. Charles County) effective August 28, 1999. The state would be responsible for the salary of a judge ($98,947), a court reporter ($44,482), and a clerk ($23,748). St Charles County would be responsible for space, equipment, and operating costs.

Officials from the Office of the State Public Defender (SPD) assume the proposal would not add to the SPD caseload; however, it will make it necessary for Assistant Public Defenders to appear in more places at the same time. Therefore an additional .5 Attorney FTE is required.

Oversight assumes the proposed legislation would not add any additional duties to the SPD; therefore, no additional FTE would be required.

Officials from the Office of Prosecution Services assume the proposal would have no fiscal impact on their agency.

In response to similar legislation, the Office of the Attorney General assumed the proposal would have no fiscal impact on their agency.

Officials from the 11th Judicial Circuit Court of Missouri assumes the proposal would reduce the case load for the existing judges and delays for litigants.

DESCRIPTION

This proposal adds one circuit judge to St. Charles County. The judge will be elected in 2000.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
