FISCAL ANALYSIS

ASSUMPTION

The Office of the State Courts Administrator assume the proposed legislation may cause a slight reduction in the number of civil suits filed; however, it does not anticipate a significant workload reduction to result.

The Department of Transportation, Department of Economic Development, Department of Insurance, and Department of Labor and Industrial Relations assume the proposed legislation would have no fiscal impact on their agencies.

No direct fiscal impact to small businesses would be expected as a result of this proposal.


DESCRIPTION

The proposed legislation will require architects, professional engineers, and land surveyors or their attorney to file an affidavit from a like licensed professional in any civil suit for damages or injuries attesting that the defendant licensed professional did not use the same care as a reasonable prudent professional would use and that such failure caused the damage claimed.

This legislation is not federally mandated, would not duplicate any other program, and would not require additional capital improvements or rental space.
