AN ACT

To repeal section E, of Proposition A as approved by the voters on November 3, 1998, relating to animal fighting, and to enact in lieu thereof one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Section E, of Proposition A as approved by the voters on November 3, 1998, is repealed and one new section enacted in lieu thereof, to be known as section E, to read as follows:

Section E.  Exemptions.-- 1.  The provisions of sections B and C shall not apply to:

(1)  Any person simulating a fight for the purpose of using the simulated fight as part of a motion picture production or a motion picture production for television, provided sections 578.009 and 578.012 are not violated;

(2)  Any person using animals to track, pursue or take wildlife or to participate in any hunting or fishing regulated by the Missouri department of conservation;

(3)  Any person using animals to herd, work or identify livestock for agricultural purposes according to recognized animal husbandry.

2.  Nothing in the provisions of sections A, B and C shall be construed to:

(1)  Prohibit breeding, rearing or slaughtering poultry pursuant to the provisions of chapters 196, 262, 265, 276 and 277;

(2)  Prohibit breeding or rearing game fowl when the game fowl are not intended for use in violation of the provisions of sections A, B or C;

(3)  Prohibit rodeo practices currently [sanctions by the Professional Rodeo Cowboy's Association] approved by the department of agriculture pursuant to subsection 3 of this section;

(4)  Prohibit the transportation of any animal upon the roads and highways of the state providing that the animal has not been illegally taken or purchased;

(5)  Prohibit any domestic livestock, farm stock dog, coon dog, fox hound, coyote dog to be transported anywhere in the state of Missouri;

(6)  Prohibit calf pinning with horse or with horse and dog;

(7)  Prohibit calf roping by any adults or minors providing the animal is treated humanely.

3.  The department of agriculture shall, by rule, provide a list of approved rodeo practices, including, but not limited to, those approved by the Professional Rodeo Cowboy's Association.

4.  No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to the provisions of chapter 536, RSMo.
